Fresh Tracks Rewards Terms and Conditions

The Fresh Tracks Rewards Program (“Program”) applies only to qualifying products sold on www.neversummer.com and at The Never Summer Factory in Denver, CO, United States

In order to receive the benefits of the Program, You must be an existing Never Summer Industries account holder at www.neversummer.com or You must visit www.neversummer.com and create and activate a Never Summer account (“Membership”) prior to Your purchase of Qualifying Products or completing a Qualifying Activity. To receive the benefits of the Program when You are shopping at a Participating Never Summer Industries Retail or Outlet Store (“Never Summer Industries Store”), prior to the completion of Your sales transaction of Qualifying Products You must inform the sales associate of Your Membership by providing Your email address associated with your Membership or ask the sales associate for assistance in creating Your Membership.

Membership is open to all individuals that reside in the United States, excluding all Territories, and are at least eighteen (18) years of age or older. Never Summer Industries will not collect personally identifiable information from any person that is known to us to be under the age of eighteen (18). The Program is available only to individuals for their personal use and is limited to one (1) account per individual. Employees of Never Summer Industries, proform customers and persons using unpublished corporate discounts are not eligible to participate in the parts or all of the Program.

The use and benefits of the Program is subject to, and shall be governed by, these Terms of Use. Never Summer Industries may, at its sole and absolute discretion, change Program rules, regulations, benefits, conditions of participation, or Reward levels, in whole or in part, at any time without notice, even though changes may affect the value of the Turns already accumulated. It is your responsibility to be aware of any such changes. Continued use of your Never Summer Industries account shall be deemed acceptance of these Terms and Conditions and any modifications thereto.

You will receive Program Points (“Turns”) based on the purchase of a Qualifying Product or the performance of a Qualifying Challenge. The amount of Turns You can earn on the purchase of a Qualifying Product or performance of a Qualifying Challenge will be determined by Never Summer Industries. The Turns You can earn upon the purchase of a Qualifying Product(s) will be determined by the price of the product(s) after any discounts are applied to Your purchase on www.neversummer.com or sales transaction at the Never Summer Industries Factory and exclude taxes, shipping and handling charges. Turns You can earn from the performance of a Qualifying Challenge will be displayed in the promotional announcement and/or materials accompanying the Qualifying Challenge. Never Summer Industries has the right to make the final decision on whether a purchase or performance qualifies for Turns.

Program members earn one (1) Turn for every $1.00 USD spent on Qualified Product(s) purchased on www.neversummer.com or at The Never Summer Industries Factory.

When purchasing Qualifying Product(s) on www.neversummer.com You must be logged into Your Never Summer Industries account on the www.neversummer.com website in order to earn Turns from purchasing Qualifying Product(s) and/or from the performance of a Qualifying Challenge. To earn Turns on purchases of Qualifying Product(s) made in a Never Summer Industries Store, prior to completion of the sales transaction when a receipt is issued, You must inform the sales associate of Your Membership by providing your email address associated with your Membership or request assistance in creating a Membership.

Never Summer Industries will post earned Turns to Your account within thirty (30) days from the purchase of a Qualifying Product or the performance of a Qualifying Challenge. Turns may only be redeemed after being posted to Your account.

Turns will be deducted on purchases of a Qualifying Product if is returned, refunded, a credit adjustment is issued, is labeled as an unauthorized or fraudulent charge, or is made by or for a business.

No Turns will be issued on purchases of a Qualifying Product if is returned, refunded, a credit adjustment is issued, is labeled as an unauthorized or fraudulent charge, or is made by or for a business or for a business purpose.

No Turns will be issued on past purchases made prior to the Program launch or prior to your Membership in the Program. This may be adjusted to Never Summer's discretion as needed.

No Turns will be earned on Qualifying Product(s) purchased with Turns.

No Turns will be earned on Qualifying Product(s) purchased by Never Summer Industries employees, Pro-form customers and customers using unpublished discount promotions.

No Turns will be earned on the purchase of a Never Summer Industries Gift Card(s).

Turns earned from purchase of Qualifying Product(s) that You return for a refund will be deducted from your overall Turns balance in your account.

Turns have no cash value and cannot be converted to or redeemed for cash, either directly or indirectly. Tax, shipping & handling and any other charges other than the purchase price of the Qualifying Product are not eligible for Turns. Shipping and handling charges apply to all products, including items purchased with Your Turns.

All Turns Redeemed are final. Turns redeemed for a product or discount code may not be refunded or exchanged for another product or cash value.

All turn redemptions are final and coupons/turns will not be refunded due to the refunding or exchanging of an order that has used a discount in relation to the Fresh Tracks Rewards Program

Turns are not transferable and may not be combined with Turns from other Program Members or conveyed by any means to anyone, including through a Member’s estate, and may not pass to Members’ successors and assigns. Accrued Turns do not constitute property of the Member. Accrued Turns are not transferable by the Member (i) upon death, (ii) as part of a domestic relations matter, or (iii) otherwise.

Turns may be redeemed 1) for a one-time use discount code (“Reward”) on future purchases of Never Summer Industries products on www.neversummer.com or at The Never Summer Industries Factory; or 2) may be used to purchase certain Never Summer Industries products or experiences offered from time to time by Never Summer Industries in exchange for Turns. To redeem Turns for a Reward, Your Membership must be active. When redeeming Turns, Turns will be deducted from Your account immediately upon successful order submission when purchasing on www.neversummer.com or when You redeem Turns for a Reward to be used in a Never Summer Industries Store.

For purchases made on www.neversummer.com, Turns are available for a Reward during the order checkout process. You must be logged-in to your Never Summer Industries Customer account to apply your available Turns to your current order. 

Turns must be redeemed in single increments values when redeemed in-person. Only one (1) Reward can be applied per sales transaction and cannot be combined with other coupon or “promo” codes.

Turns expire twelve (12) months from the date of your Turns issued on a purchase of Qualifying Product or performance of a Qualifying Activity.

Returns of Qualifying Product purchased with a Rewards or in combination of another method of payment will be managed as set for below.

• Returns must be returned to their original point of purchase
• A Return made in their entirety will be refunded to the original method of payment and NO Turns redeemed or used as a coupon will be credited back to the Membership account.
• A partial Return of a multi-item purchase will be refunded to the original method of payment, but the Reward will remain used and no Turns will be credited back to the Membership account

Your eligibility to achieve Rider, Shredder, Ripper, Local, and Legend tiers (“Status”) in the Program is based on Your cumulative Turn(s) of Qualifying Product(s) made at www.neversummer.com and at The Never Summer Industries Factory over a twelve (12) month period. Your eligibility to move up in tier status within the Program will be updated regularly based on Your Total Turns accumulated through Qualifying Products and Qualifying Challenges Minus Deductions During Prior Twelve (12) Months (“Net Turns”) of Qualifying Products as set forth below.

RIDER: Your total turn(s) accumulated through Qualifying Products and Qualifying Challenges is less than 6500 turns over a twelve (12) month period beginning from the date You entered the RIDER tier status.

RIDER tier membership receives the following benefits set forth below:

• An account on www.neversummer.com
• Access to earning turns via Qualifying Challenges and Qualifying Purchases

SHREDDER: Your total turn(s) accumulated through Qualifying Products and Qualifying Challenges is between 6500 turns and 7249 turns over a twelve (12) month period beginning from the date You achieved the SHREDDER tier status.

In addition to the RIDER tier benefits, SHREDDER tier members also receive:

• Early Access to Limited Snowboard Drops
• Access to double & triple turns events (like happy hour)

RIPPER: Your total turn(s) accumulated through Qualifying Products and Qualifying Challenges is between 7250 turns and 7999 turns over a twelve (12) month period beginning from the date You achieved the RIPPER tier status.

In addition to the RIDER & SHREDDER tier benefits, RIPPER tier members also receive:

• Invitations to Vince the Chairman R&D Demos (Product testing)
• 500 bonus turns/month

LOCAL: Your total turn(s) accumulated through Qualifying Products and Qualifying Challenges is between 8000 turns and 9999 turns over a twelve (12) month period beginning from the date You achieved the LOCAL tier status.

In addition to the RIDER & SHREDDER & RIPPER tier benefits, LOCAL tier members also receive:

• Opportunity to redeem points for a seat with the NS crew on a Jones Pass Cat Snowboarding Trip
• Free 2-Day FedEx Shipping to US Addresses. (Subject to Availability) 

LEGEND: Your total turn(s) accumulated through Qualifying Products and Qualifying Challenges is over 10000 turns over a twelve (12) month period beginning from the date You achieved the VIP tier status.

In addition to the RIDER & SHREDDER & RIPPER & LOCAL tier benefits, LEGEND tier members also receive:

• Exclusive opportunities (Ride with the team, participate in some NS events, learn about and buy drops before anyone else (these opportunities are subject to Never Summer's discretion and may be made available at anytime of choice))

Once You reach the qualifying total turn(s) accumulated through Qualifying Products and Qualifying Challenges for any member Status, Your benefits for that Status include all of the benefits associated with the preceding Status.

Your current Status in a tier lasts for twelve (12) months beginning on the date You achieved the tier Status unless you make additional purchases of Qualifying Product that moves you to the next tier. To retain Your Status in a tier, Your total total turn(s) accumulated through Qualifying Products and Qualifying Challenges over the twelve (12) months beginning the date your achieved Your tier Status must equal Your current tier’s minimum required total in Net Purchase of Qualifying Product.

As part of the Program, You may receive print/electronic Turns Statements, Program updates and other related materials at the discretion of Never Summer Industries. Never Summer Industries reserves the right to cease providing Program updates and related materials to You.

You can view Your account activity online at www.neversummer.com. For information about an individual account or any other Program-related questions or information contact Never Summer Industries Customer Service by visiting: www.neversummer.com/pages/contact.

To the extent provided by law, Never Summer Industries reserves the right to make Rewards and promotional offers available to select Never Summer Industries account holders based on purchase activity, geographic location, Program participation, or information supplied by You.

You may cancel Your Membership at any time by notifying Never Summer Industries Customer Service by mail, email or telephone.

We reserve the right to close your account at any time if there is no account activity for a period of two (2) years, which will result in the forfeiture of any and all accumulated Turns. For the purposes of these Terms and Conditions, “account activity” shall mean any purchases, or redemption of Turns. Never Summer Industries shall reasonably determine if an account is inactive at its sole and absolute discretion.

The information provided by You will be handled according to the Never Summer Industries Privacy Policy. If You are interested in learning more about Never Summer Industries privacy practices, please visit www.neversummer.com and click on the Privacy Policy link in the bottom navigation menu.

We may terminate the Program and/or your Membership at any time at Our discretion. If We do so without cause, We will provide you with at least ninety (90) days to redeem any Turns you have earned prior to any termination of your Membership or the Program.

Abuse of the Program by failing to follow these Terms and Conditions, conducting any fraudulent or illegal activities, purchasing products with the intent to resell, “hacking”, misrepresenting or falsifying any facts presented to Never Summer Industries, participating in any activity disparaging to or not in the best interest of Never Summer Industries or other Never Summer Industries account holders, or conducting any other improper conduct as determined by Never Summer Industries in its sole judgment, may result in immediate cancellation of your Membership and future disqualification from Program or participation in other Never Summer Industries promotional programs, forfeiture of all Turns accrued, cancellation of previously issued but unused Turns, and termination of the business relationship with Never Summer Industries. In connection with the enforcement of any of the Terms and Conditions governing the Program, Never Summer Industries reserves the right to take appropriate legal action, as it deems necessary, and to recover damages, attorneys’ fees and court costs.

Our failure to insist upon or enforce Your strict compliance with these Terms and Conditions will not constitute a waiver of any of Our rights.

Taxes may apply where required by law. You shall be responsible for any taxes that you may incur for receiving and/or redeeming Turns.

All determinations by Never Summer Industries shall be final and conclusive in each case.
